Items that are not usually considered within the planning decision

It is best to not mention the items below if your objective is to have the planning application refused.  (It is recognised that some of these items can be mentioned if they are used as a supporting arguments.)

  1. Loss of property value
  2. Commercial competition
  3. Loss of a view (unless you live in a conservation area or a national park)
  4. Disturbances during building work (although this can sometimes be addressed with conditions that seek to reduce the level of disturbance to neighbours)
  5. Land ownership disputes  (addressed via solicitors and the courts)
  6. Formal or informal rights of way that may be blocked or impeded by the proposal
  7. Private deeds or covenants
  8. The fact that development has already started or is complete
  9. Matters covered by other legislation including licensing or gambling



Your local Residents’ Association may be able to assist with this process. If you do not have a local residents’ association then seriously consider creating one.
